Terms of Service

Found is operated by Found Social Club, doing business as Found ("Found," "we," "our," or "us"). Please read these Terms of Service carefully before using Found. By creating an account or using the app, you agree to be bound by these terms. If you do not agree, do not use Found.

1. Eligibility

Found is intended solely for adults aged 18 and older who identify as queer women, transgender, or non-binary. By creating an account, you confirm that you are at least 18 years old and that the information you provide is accurate. We reserve the right to terminate any account we believe belongs to someone under 18 or who does not meet our community criteria.

2. User conduct

You agree not to use Found to harass, threaten, or harm other users. You agree not to post false information, impersonate others, or use the app for any unlawful purpose. Found reserves the right to remove any content and suspend or permanently ban any user at any time, for any reason, without notice or refund.

3. Events on Found

Found is built around real-world events — concerts, sports, and community gatherings. Some events come from public ticketing platforms like Ticketmaster; others are submitted by community members or by verified organizers through our Organizer Portal. Found does not own, operate, host, or control any event listed in the app, and is not responsible for an event's cancellation, safety, quality, or the conduct of its organizers or attendees. Event organizers are independent third parties — not Found employees or agents. Ticket purchases for third-party events happen on that organizer's or platform's own site; Found is not a party to that transaction and is not responsible for refunds, ticket validity, or venue conditions. When you RSVP to an event, other attendees of that event may be able to see that you're going. Organizers can see how many people RSVP'd, but not who, unless you separately match or connect with them.

4. In-person meetings

Found facilitates connections between users at real-world events. We are not responsible for the actions, behavior, or conduct of any user you meet through the app — online or in person. You assume all risk associated with meeting other users, including attending any event you find through Found. We strongly encourage meeting in public places and telling someone where you are going.

Found is not liable for any injury, harm, loss, or damage — physical, emotional, or financial — arising from in-person interactions between users or attendance at any event. Use your judgment. Your safety is your responsibility.

5. Limitation of liability

To the maximum extent permitted by law, Found and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of data, loss of revenue, personal injury, or emotional distress — arising out of or related to your use of the app, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or related to these Terms or your use of Found shall not exceed the amount you paid to Found in the 12 months preceding the claim, or $100, whichever is less.

6. Binding arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of Found — including disputes about the validity, enforceability, or scope of this arbitration agreement — shall be resolved exclusively through final and binding individual arbitration, rather than in court. You waive your right to a jury trial and your right to participate in a class action lawsuit or class-wide arbitration. Arbitration shall be conducted by a neutral arbitrator under the rules of the American Arbitration Association (AAA). The arbitration will take place in Los Angeles, California, unless otherwise agreed. This arbitration agreement does not apply to: (a) small claims court actions within applicable jurisdictional limits; or (b) claims for injunctive or equitable relief to protect intellectual property rights.

7. Class action waiver

You agree that any dispute resolution proceeding will be conducted only on an individual basis and not as a class, consolidated, or representative action. You waive any right to bring or participate in a class action, class arbitration, or any other representative proceeding against Found.

8. Indemnification

You agree to indemnify, defend, and hold harmless Found and its owners, officers, employees, and affiliates from any claims, damages, liabilities, costs, or expenses (including attorney's fees) arising from: (a) your use of the app; (b) your violation of these Terms; (c) your interaction with any other user; (d) your attendance at any event found through Found; or (e) any content you submit to the app.

9. Subscriptions and purchases

Found offers optional paid features through Apple's in-app purchase system: Found Membership (Elite) subscriptions, Direct Connect credits (which let you message a specific person before matching), and Event Passes. All purchases are subject to Apple's terms and conditions. Subscriptions automatically renew unless cancelled at least 24 hours before the renewal date. Direct Connect credits and Event Passes are non-transferable and have no cash value. Found does not offer refunds for purchases, except as required by applicable law or Apple's refund policies.

10. California residents

If you're a California resident, state law gives you the right to cancel a subscription, without penalty or obligation, at any time before midnight of the third business day after you subscribed. If you subscribed through your Apple ID, that cancellation and any refund is handled by Apple — go to Settings on your device, or visit getsupport.apple.com. Under California Civil Code §1789.3, you may also report complaints to the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs at 1625 North Market Blvd., Suite N112, Sacramento, CA 95834, or by phone at (800) 952-5210.

11. Content

You retain ownership of content you submit to Found. By submitting content, you grant Found a non-exclusive, royalty-free, worldwide license to use, display, and distribute your content within the app. You are solely responsible for the content you post. Found reserves the right to remove any content that violates these Terms or our community standards.

12. Termination

We may suspend or terminate your account at any time, for any reason, without notice. You may delete your account at any time from the Profile screen — deletion is permanent and immediate, with no waiting period. Upon termination, your right to use Found ceases immediately. Sections 5, 6, 7, and 8 survive termination.

13. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles. To the extent any dispute is not subject to arbitration, you consent to exclusive jurisdiction in the state and federal courts located in Los Angeles County, California.

14. Changes to these terms

We may update these Terms at any time. When we do, we'll notify you via in-app notice and update the date above. Continued use of Found after changes constitutes acceptance of the updated Terms.
